ロシア極東地域での不法伐採と木材貿易

ロシア極東には、2億2520万ヘクタールの森林があり、2040億立米の森林蓄積量、4830万立米の年間伐採可能量がある。2001年の産業用木材の伐採量は980万立米であった。ロシア極東の森林セクターでは、ほとんどの木材を北東アジアに輸出している。


不法伐採とは、保護地区や伐採禁止地区、伐採許可権を得た範囲外での伐採、賄賂による伐採許可権の入手、伐採免許の偽造、保護されている樹種の伐採、公共林からの規定寸法以下/以上の樹木の移動、許可量を超える伐採、不法取引及び密輸、移転価格などの不法な会計慣行、不法な森林手続きなどである。

 

不法な森林活動を行う動機は、税金などの当局への課徴金を払わないことで余分の収入を得たいとか、当局の手続きでは入手できない森林資源にアクセスするためである。不法伐採の可能性は、次の3つの主要な要因に関連している。州境や港湾に近いか、質の高い森林資源が入手できるか、そして、特に地元当局の公務員がどれほど犯罪に関わっているかである。筆者は、異なった度合いの森林操業の不法性を有する4つの地理的ゾーンを選択した。

生産/取引の流れは、免許の入手、伐採、運搬、木材の倉庫運び込みと仕分け、通関という段階に分かれる。不法行為を行う機会ややり口、関与者、および取り締まりの可能性は、各段階によってそれぞれ異なる。

不法な森林操業を引き起こす要因には、国内的なものと対外的なものの両方がある。内的な要因は、長期にわたる経済危機や高いインフレ率、国内消費の激減、全体的な支払不能状態などである。対外的な要因には、現金の安定収入源を得たいという強い希望、ロシアの伐採業者と不法な超過収益を山分けしようという外国の取引パートナーがてぐすねをひいて待っていること、不公正な競争、中国での木材需要の急増などがある。ロシア経済も中国経済も、極めて腐敗していることは知られている。現在では、合法的な操業と不法な操業を混ぜて、取り締まりにくくした中国−ロシア間の木材貿易が入り組んだ網の目のように広がっている。特に極めて不法な操業が行われているのは、トネリコやオークといった堅材である。これらの樹種は、特定の場所にしか生えておらず、その伐採は厳しく制限されている。しかし、中国でのこれらの木に対する需要は大きい。これらの木の価格は、軟材よりも高いのである。ロシアの堅材のかなりの部分は、加工後、中国から日本に再輸出されている。日本への不法輸出は、中国への不法輸出ほど遠慮なく行われているわけではなく、総輸出量に占める割合もより少ないが、やはりあるにはある。

当然のことながら、不法伐採の実際の規模について知っている人はいない。推計されている不法伐採量は、合法的な産出量の0.5%というものから100%にあたるというものまで、非常に幅がある。筆者は、州境に近い地区では50〜70%、もっとも極東にあたる地区では20〜30%、ロシア極東全体の平均は50%を下ることはないだろうと推定している。

不法伐採に関するロシアの公式の立場は、極めて厳しく不法伐採を拒否するものである。しかし現実には、犯人たちの仲間と一部役人の間の協力がなければ、これほどの不法伐採を行うことはできない。土地の賃貸者、特に大手の賃貸者は、密伐者から自分の土地を守っているが、なかには不法伐採を行っているものもある。短期(1年未満)の利用はより不法行為の可能性が高い。

国民は、不法伐採に対する強い不安を抱いている。特に、精力的に活動している地元のNGOや国際的なNGOは、会合や広報活動のみならず、現地での取り締まりにも大変積極的である。ロシアの連邦政府や地元政府も、状況を憂慮している。数多くの様々な措置が取られている。管理や取り締まりのための特別な機関の設立、特にさまざまな相互取り締まり文書や取り締まりポイントの設定など、取り締まりシステムの強化、あらゆる手続きの透明性を強め、周知徹底するなど。しかし、これらの措置はどれも、役人が強力に施行してはじめて機能するものである。役人の一部が不正に加担しているかぎり、どのような措置もその効果を存分に発揮することはできない。

森林セクターの不法行為だけをなくそうとするのは不可能である。森林セクターは、経済全体の一部であり、森林における合法性は、経済全体に共通する合法性とまったく異なるものではありえないからだ。全般的な犯罪性や腐敗は、ロシアが現在抱えている大問題のリストに含まれており、その解決をはかることは、極めて重要な国家的課題である。

目を配る範囲を議論する中で、二つの主要な将来のシナリオが現実的である。
1."今のまま"が続くシナリオ:収穫量と収穫面積が漸増し、不法伐採の割合は変わらず、不法伐採のフローが次第に国内市場にも広がり、疑わしい出所からの森林産物ということで国際市場での規制が強まっていく。
2.転換シナリオ:伐採量の増大とより緩やかな伐採地域の拡大、低品位木材や小径木の利用の増加、不法伐採の急減、持続可能性への緩やかなシフト、国際市場での立場の強化。これらのシナリオを実現するには、しっかりとした政治的な意思が必要である。

連邦政府及び地元政府は、汚職を行っている役人スタッフを一掃し、施行された法律をためらうことなく執行し、法や条例の一部を改善し、新しい法律を導入しなくてはならない。実際に不法伐採を止められるのは、有能で強力で、しかも腐敗していない森林部(Forest Service)だけなのだ。木材業者は、いくら自分たちが非常に正直であったとしても、不法伐採は国際市場へのアクセスを失う原因になりかねないことを理解すべきである。事業を浄化することは、地元森林産業の共通の利害である。この状況下で、森林認証は、森林セクターにおける不法伐採やその他の不法行為に対する重要な手段となる。国外消費者も含め消費者の強い要望が促進役となって、認証とロシア極東の森林セクターにおける不法行為の撲滅を進められるだろう。

私の結論は、「不法行為に打ち勝つには、極めて多岐にわたる利害関係者の活動をひとつに結びつけなくてはならない」ということである。

ILLEGAL LOGGING AND TIMBER TRADE IN THE RUSSIAN FAR EAST

The Russian Far East (RFE) has 225.2 mln ha of forests, 20.4 bln cu. meters of wood stock, and 48.3 mln cu. meters of annual allowable cut. Harvesting of industrial wood in 2001 was 9.8 mln cu. meters. The RFE forest sector mostly exports timber to Northeast Asia.

The illegal logging embraces logging in protected and prohibited areas, and outside concession boundaries; obtaining logging concessions through bribes; falsification of felling licenses; logging of protected species; removing under/oversized trees from public forests; extracting more than authorized amounts of timber; illegal trade, and smuggling; transfer pricing and other illegal accounting practices; illegal forest procedures etc.

Motivations of illegal forest activities are: to catch surplus income by nonpayment of taxes and other official charges; to get access to forest resources that are not available by official procedure. Possibilities for illegal logging is concerned with three main factors: closeness to state boarders or ports; availability of good quality forest resources; degree of criminality of public life especially of local authority. Author of the lecture marked out four geographical zones with different degree of forest operation illegality.

There are consecution of production/trade phases: license receiving; logging; transportation; warehousing (yarding) and sorting of timber; custom control. Each phase has different illegal opportunities, tricks, participants, and possibilities of control.

Illegal forest operations are simulated by both interior and exterior factors. The interior factors are long economic crisis, high inflation, big reduction of interior consumption, and total insolvency. The exterior ones are aspiration to have stable source of hard currency; readiness of some foreign trade partners to divide illegal surplus with Russian loggers; unfair competition; rapid increase of timber demand in China etc. It is known that both Russian and China economy are very corrupt. We have now complicated net of China-Russian timber trade that mixes legal and illegal operations and decrease chances to control them. Especially high illegality is peculiar to logging of hardwood: ash and oak. These species growth only in specific sites and their harvesting strictly limited. However there is big demand for them in China. Their price is higher than price of softwood logs. Significant part of the Russian hardwood is re-exported from China to Japan after processing. Illegal export to Japan is not so blunt as to China and makes less share of total export but it exists also.

Naturally that real size of illegal logging nobody knows. There are very extreme estimations: from 0.5 to 100 percent in comparison to legal output. Author of lecture estimates it as not less than 40 percent in average for the RFE with magnitude from 50-70 % in the zone that is nearest to state boards to 20-30 % in the zone that is the furthest one.

Russian official position on illegal logging is very strict and negative. However in reality such level of illegality is possible only on the base of cooperation between criminal circles and some part of officials. Leasers especially large ones protect their lease plots from poachers but some of them apply illegal logging. Short-term (less than 1 year) use is more illegal.

Public is very anxious about illegal logging. Especially energetic are local and international NGOs, they are very active not only in meetings, publications etc., but in real field control. The Russian federal and local governments also worry about the situation. Many different measures are undertaken: establishment of special managing and regulating institutions; strengthening of control system particularly establishing of different cross-controlled documents, points for control etc.; increasing transparency and publicity of all procedures. However all these measures work only if they are strongly implemented by officials. As long as part of officials is corrupted no any measures will have effect in full degree. It is impossible to establish legality only in the forest sector. The latter is the part of entire economy and forest legality can't be very different from common legality. General criminality and corruption are in the list of the main current problems of Russia, and their solution is very important national task.

Two main scenarios in the future from the discussing scope of view are real:
1. Inertial scenario - slow increase of harvested volume and area, stable share of illegality, slow extent of illegal flow to interior market, strengthening of restrictions in international markets because suspicious origin of forest products.
2. Transforming scenario - increase of harvested volume and more slow expansion of harvesting by area, increasing use of low grade and small size timber, fast decrease of illegal logging, slow shift to sustainability, strengthening positions in the international market. Implementation of these scenario demands of strong political will.

Federal and local governments must clear their staff of corrupted persons, implement laws in force without any hesitation, improve some acts, and introduce some new laws. Only strong, competent and not corrupted Forest Service can really stop illegal logging. Timber businessman must understand that illegal logging can be cause of loss of access to international markets even if they are very honest. It is common interest of the local forest industry to purify business. In this situation the forest certification becomes important measure against illegal logging and other illegality in the forest sector. Pressing from consumer groups including foreign ones can became a catalyst both certification and cleaning from illegality in the RFE forest sector.

My conclusion is: to win illegality we must unite activity of very different stakeholders.
